Mediation Philosophy - The individuals closest to the problem are the best experts on the problem. Therefore the best experts deliver the best solutions.
Mediation is a voluntary, informal process in which a mediator assists two or more parties in reaching a mutually acceptable settlement of their dispute. As mediators we will not take one side or the other in helping people resolve their disputes. Your mediator may offer suggestions, but resolution of the dispute rests with the parties themselves. The mediation proceedings are strictly confidential and private. If the parties are unable to reach a settlement, they are free to pursue other options. Mediation is quicker and a great deal less expensive than litigation. Typically the cost of mediation is divided equally between parties.

Background
Michael Hackett is a Rule 31 Listed General Civil Mediator based in Brentwood, Tennessee. He received his mediation training at Lipscomb University. Michael is a retired human resource executive who has distinguished himself in the field of human resource management, with more than 40 years HR experience in manufacturing, government, telecommunications, security and the health care industries. Michael holds BS and MS degrees from The University of Memphis and specializes in employment, general business, and faith based mediation. Michael has served as an adjunct professor of business. He also served as an instructor for The University of Memphis, where he taught a variety of management, leadership and strategic planning courses. Michael has authored numerous management articles in trade and professional journals. As conference leader, he has conducted training programs for industry, government, hospitals, universities, and professional associations. Michael provides mediation service to all counties in Tennessee.

Fee Information
Cost of Mediation
The parties will compensate the mediator at an hourly rate of $125 (shared equally) for mediation services that includes: conference calls, correspondence, review of written submissions, the mediation session, and post-mediation communications. If two mediators are required or requested no additional cost other than reasonable out of pocket expenses for the second mediator is required. In addition the parties will reimburse the mediator or mediators for all reasonable expenses incurred on the parties’ behalf, including: travel (in excess of 20 miles one way), lodging, meals, postage, and other out of pocket expenses. The parties agree to share equally the cost of the mediation, and therefore the payment of the mediator’s fees and expenses will not be an issue in the mediation. No later than two days before the mediation, the parties will pay the mediator an estimated payment for 5 hours for the mediation session. If the mediation session is less than 5 hours, the mediator will refund the difference to the parties at the end of the mediation. If the mediation is more than five hours, the parties will pay the mediator the balance due within 5 working days of the conclusion of the mediation.

We offer a short workshop for any individual or organization wishing to learn more about the mediation process. Training topics include: how the mediation process works, how to prepare for mediation, how to present your case, the proper mediation demeanor, roles of the mediation parties, good faith negotiating, and preparing a final settlement document.



Cost for Faith Based Mediation
There is no charge for Faith Based Mediation other than travel, lodging, meals and any other reasonable out of pocket expenses. Faith based mediation includes such organizations as churches, synagogues, faith based schools etc.
